Street Traders Licence Conditions

Conditions contained in a Street Traders Licence

  1. The holder of a street trader's licence shall not be less than 18 years of age.
  2. A street trader while street trading shall have with him the licence issued to him by the Licensing Authority which he shall keep at all times clean and legible and shall exhibit on demand to any Consumer Protection Officer or Inspector of Weights and Measures, any Environmental Health Officer, any Constable or authorised officer of the Licensing Authority, on production by that Officer, Inspector, Constable or other officer of his badge of office or written evidence of his appointment to that office, and shall allow such Officer, Inspector, Constable or other officer to note the particulars contained therein.
  3. A street trader while street trading shall display the badge issued to him by the Licensing Authority conspicuously on his outer garment so that the writing and any other thing thereon shall be clearly visible and must, when required, permit any person to inspect same and to note the particulars contained therein.
  4. A street trader shall not in any way alter, erase or deface his licence and/or badge and shall, when reasonably required, produce said item(s) for examination by the Head of Legal Services at the Licensing Section, Chief Executive's Department, Glasgow.
  5. Where the goods or articles sold or which are offered for sale by the person engaged or employed in street trading are of a perishable nature, or are intended for human consumption, the licenceholder shall not store such goods or articles in any vehicle until the said vehicle has been approved for that purpose by Environmental Health. Whenever such a Certificate reaches its expiry date the Licenceholder shall, without further reminder from the Licensing Authority, ensure that a valid replacement Certificate is obtained within such time as to ensure that there is no period during for which there is no valid certificate of compliance in force.  The Licenceholder shall then ensure that any such Certificate is produced to the Licensing Authority as soon as it has been issued by Environmental Health
  6. Where the vehicle, kiosk or moveable stall is used for the sale of food, it shall contain (a) adequate facilities for the proper cleaning and/or sterilising of all utensils and equipment used in connection therewith and (b)  appropriate facilities to maintain adequate personal hygiene as shall be to the satisfaction of the Head of Environmental Health and shall comply at all times with the Food Safety Act 1990 and the Regulations made thereunder.    On written notice, signed by the Head of Environmental Health or any other person authorised by this Licensing Authority to sign such notices, being given to any street trader that he has become unsuitable in respect of the unsatisfactory condition of his clothing or person, or that the vehicle, kiosk or moveable stall is unsuitable, such street trader shall immediately cease to act as a street trader until he remedies the cause of complaint to the satisfaction of the Head of Environmental Health or until the said notice is withdrawn; and such notices shall be recorded in a Register for the purpose and be available during normal office hours for public inspection.
  7. Every street trader shall collect and remove any paper, garbage or other refuse which may be produced, or may accumulate in the course of trading and shall not place or deposit same, allow same to be placed or deposited or to fall on any street, foot-pavement or footway or on adjoining property.  Without prejudice to the foregoing generality, every street trader trading at a particular location for a period exceeding five minutes shall place at that location a litter bin or other receptacle for the deposit of paper, garbage or other refuse by customers.
  8. A street trader who has charge of any vehicle, kiosk or moveable stall shall not cause or allow same to stand on or within a distance of 10 metres from any pedestrian crossing.
  9. Notwithstanding the terms and conditions contained in his licence, every street trader shall comply with any order or instruction given by any Constable for the prevention of obstruction or annoyance to the public or to the occupiers of any premises or in connection with any emergency or disturbance or on any occasion when such Constable in his discretion may consider it necessary in the public interest to give such order or instruction.
  10. The licenceholder shall not, without the consent of the Licensing Authority, sell or offer for sale any goods or carry out or offer to carry out for money or money's worth any service at any place other than as specified in his licence.
  11.  Except as otherwise directed by the Licensing Authority, no street trader shall engage in street trading within 150 metres of any establishment or premises in which are sold or offered for sale any goods or articles or services of the same or similar class and description as those to be sold or offered for sale by the street trader.  The Licensing Authority may in their sole discretion and on application direct that the terms hereof shall not apply to a particular street trader in a particular street or locality or area and such a direction shall not be effective until it is endorsed by the Head of Legal Services on his licence.
  12.  Where the licence allows the holder to trade from a vehicle, kiosk or moveable stall other than at a fixed stance the licenceholder shall remain in the same place only for the time it takes to serve the queueing customers and shall then move on.
  13. Where the licence allows the holder to sell from a vehicle, kiosk or moveable stall at an approved stance, the vehicle, kiosk or moveable stall shall be capable of being speedily and easily removed.  At the end of any period of trading, the licenceholder shall immediately remove the vehicle, kiosk or moveable stall from the approved stance.
  14.  Street trading in that area of the City of Glasgow bounded by and including the whole of Clyde Street, Broomielaw, York Street, Argyle Street, Pitt Street, St. Vincent Street, North Street, Sauchiehall Street, St. George's Road, Renfrew Street, Cambridge Street, Cowcaddens Road, North Hanover Street, Cathedral Street, North Frederick Path, North Frederick Street, George Square, George Street, High Street, Bell Street, Hunter Street, Bain Street, London Road, Greendyke Street and Saltmarket, shall take place only at fixed stances as designated in the relevant street trader's licence.   15. Subject to Condition (16), within the undernoted exclusion zones, on the occasion of any football match being held at the undernoted football stadia, street trading shall take place only at fixed stances as designated in the relevant street trader's licence.
    • Ibrox Football Stadium Edmiston Drive
      The area bounded by and including all of Helen Street, Paisley Road West, Whitefield Road, Woodville Street, all of Copland Road, Brighton Street (projected to Broomloan Road), all of Broomloan Road, Dava Street (projected to Helen Street) and Harmony Row.

    • Hampden Football Stadium Letherby Drive
      The area bounded by and including Prospecthill Road, Aikenhead Road, Mount Annan Drive, Carmunnock Road and Cathcart Road.

    • Celtic Park Kerrydale Street
      The area bounded by and including all of Springfield Road, Whitby Street, Bogside Street, Kinnear Road, London Road, Stamford Street, all of Janefield Street, Camlachie Street and Holywell Street.

    • Firhill Football Stadium 80 Firhill Road
      The area bounded by and including Firhill Road (from North Drive to Garscube Road), Firhill Street, Springbank Street, Northpark Street, North Drive and South Drive.

  16. Where any licenceholder is authorised to sell football programmes or football memorabilia within or outwith any of the exclusion zones referred to at Condition (15), whether such licenceholder is operating as a mobile street trader or fixed stance trader, the following additional conditions shall apply to such traders:

    • "Fixed stance trader" means any trader licensed to trade at a fixed location within or outwith the particular exclusion zone where the goods are sold, supplied or displayed from a permanent, semi permanent or mobile structure or device, including a vehicle, kiosk or moveable stall.
    • "Mobile street trader" means any trader licensed to trade at random locations within or outwith the particular exclusion zone but only in such a way that the goods being sold, supplied or displayed and the money received in exchange for such goods are at all times in the course of trading, carried on the person of the licenceholder and specifically excludes trading as a fixed stance trader.
    • "Football memorabilia" means hats, scarves, pennants and any other type of goods approved in writing by the licensing authority, which contains colours, designs, insignia, individual words or groupings of words associated with, or which can reasonably be construed as being associated with, any football team.
    • "Football programme" means the official programme for the match taking place on the day when trading is being carried on in terms of this licence or the official programme of any other football match including any replica thereof, or other official publication, produced by, or on the authority of, one or other of the teams taking part in that day's match.
      • In addition to complying with those requirements in terms of Condition (9), the licenceholder shall immediately comply with any order or instruction given by a police constable in the interests of public order or safety at any football match.
      • The licenceholder shall not sell, supply or display any goods other than football programmes or football memorabilia which must not contain any design, insignia, word or groupings of words, which have a political, racial, religious or sectarian content or which could reasonably be construed as inciting political, racial, religious or sectarian hatred or violence.
      • Any licenceholder operating as a mobile street trader within any of the exclusion zones, shall not trade from privately owned property unless they have received written authority to do so from the owner of that property.  The licenceholder shall produce such written authority on demand to a police constable, trading standards officer or other person authorised by the licensing authority or the owners of the property.
      • The licenceholder whether operating as a fixed stance trader or a mobile street trader, shall at all times in the course of trading, comply with Condition (2) (requirement to carry and produce licence on demand) and Condition (3) (required to display badge for inspection by any person)(v)  In this condition, the expression:
  17. A street trader who changes his address shall within 14 days thereafter give notice thereof to the Licensing Authority and shall produce his licence to the Head of Legal Services who shall endorse thereon the particulars of such change of address.
  18. A street trader who is licensed to trade from more than one stance and who ceases to trade from one or more but not all of the said stances shall within three months thereafter give notice thereof to the Licensing Authority  thereby surrendering the relevant part(s) of his licence and shall produce his licence to the Head of Legal Services who shall endorse thereon the particulars of such surrender. 
  19. A street trader who ceases to act as such for the unexpired period of his licence shall, within three months thereafter, give notice thereof to the Licensing Authority and surrender his licence and badge to the Head of Legal Services.
  20. If during the currency of the licence, the Holder is convicted of any offence, they shall, within 28 days, provide full details of such convictions, in writing, to the Licensing Authority.
  21. Except so far as otherwise permitted by the Licensing Authority, no street trader shall engage in street trading involving the selling or provision of food and/or soft drinks of any description within 300 metres of any secondary school premises at any time between 8.00am to 9.00am, 10.00am to 11.00am, 12noon to 2.00pm and from 3.00pm to 5.00pm Mondays to Fridays inclusive during the school term as determined by the Education Authority from time to time.
