A Stopping Up Order or a Diversion Order is a legal order under Section 207 and/or Section 208 of the Town and Country Planning (Scotland) Act 1997 (as amended).

If there is a need to stop up or divert a road (but not a trunk road), footway, footpath, core path or bridleway permanently, to enable a development to be carried out in accordance with planning permission granted under Part III of the aforementioned Act, the Council must promote a Stopping Up Order or a Diversion Order.

When works are undertaken which will remove the right of access of a route, a formal application for a Stopping Up/Diversion Order must be sought to allow interested parties including the gas, electricity and telecommunications providers, the opportunity to assess the implications of the works.

Consultation Period

Any new Stopping Up/Diversion Order will be published on the TellMe Scotland website and advertised in the local press (Glasgow Times) and Edinburgh Gazette.

The Orders are available for public viewing in the Council Office at 231 George Street, Glasgow G1 1RX, free of charge, Monday to Friday 8 am - 4 pm (excluding public holidays) for a period of 28 days from the date of the advertisement. 

How to Make a Comment

The most straightforward way to submit your comments on a Stopping Up/Diversion Order is through the Council's Online Planning Service. In order to comment in this way, you must Register/Login to the Online Planning Service.

Comments will be accepted for a period of 28 days from the date of the consultation advertisement.   Any comments received after this time cannot be considered.

Details of your representation should be emailed to Online Planning, quoting the name of the Order.

Should any objections be received and subsequently lifted, the Order will be confirmed as an unopposed Order by the City Council. Alternatively, the Order may be submitted to the Scottish Ministers for consideration as an opposed Order.

Please note that comments cannot be kept confidential.  Any comments deemed to be racist or offensive cannot be considered and may be passed to Police Scotland.

Alternatively, comments can be submitted in writing, quoting the Order reference number and site address to Planning and Building Standards, Glasgow City Council, 231 George Street, Glasgow G1 1RX.

Comments submitted must be signed, dated and have an address for an acknowledgement to be sent to. They should clearly state the reference number of the Order  you want to comment on, and the grounds on which the representation is made.

Pre-printed or standard copied letters of representation will be accepted for consideration, if they are individually addressed, signed and dated. These details are required so that the Council can send you or the persons making comments individual letters of acknowledgement that it has received the representation.

Anonymous letters of representation will not be considered.

Petitions for or against a proposal may be submitted. These will be accepted and considered if:

  • Each page of the petition is headed with the objective of the petition;
  • Signatories provide their name and addresses in a legible fashion; and
  • The name and address of the petition organiser is included, so that the Council can send a letter of acknowledgement that it has received the petition.

 

What happens if I make a representation

Your representation will be acknowledged. Any representations you make will be made available online.  Your representation will be passed to the Agent/Applicant and they will be asked to liaise with you as required.  

Glasgow City Council respects your personal information and undertakes to comply with Data Protection. To meet requirements of Planning legislation, all representations, including your name and address, are made available for inspection both on the internet and at Council Offices during the processing of the application. Once the application has been determined, representations will be removed from the internet, although a copy will be retained on file.

You will be advised in writing of the Council's decision. Anonymous objections will not be considered. You do not have the right of appeal against this decision.

How to Apply

To apply for a Stopping Up/Diversion Order please complete the Online Form.   Please see the "Checklist" section below for any supporting documents required with your submission.

There is a fee of £1,810 which should be made by BACs payment to Glasgow City Council.  Please see section below on "How to Make a Payment" for details.

You should only apply for a Stopping Up/Diversion Order once planning consent has been issued by the Glasgow City Council. Should the site not have the appropriate consent, you can apply for it Online.

Please see below supporting documents required for your submission when applying:

  • Approved planning permission copy decision notice (if available).
  • One existing site layout plan showing area to be Stopped Up/Diverted (shown as hatched and with Scale Bar).
  • One proposed site layout plan, overlaid on existing site layout plan showing area to be Stopped Up/Diverted (shown as hatched and with Scale Bar).
  • Copies of correspondence with GCC employees.
  • Fee of £1,810 paid to Glasgow City Council

Please Note:

  • Any plan(s) provided should be drawn to a scale of 1:1250 or 1:500 with a scale bar and North point.
  • Any plan(s) provided electronically must be in pdf format and state clearly what size they should be printed.

 

How to Make a Payment

The fee of £1,810 should be made for the application by BACs payment to Glasgow City Council, Planning and Building Standards, 231 George Street, Glasgow using the undernoted details:
