Knife Dealer's Licence Conditions

1. The Licenceholder must make detailed written records on the day of the transaction with a customer and retain such records for a period of 3 years from that date stating the following information:
   (a)   the identity of the customer and the means by which the customer's identity was verified 
   (b)   the steps taken to establish that the customer was at least eighteen years of age at the time of the
           transaction (including any proof of age or identity sought or the means by which the customer's age
           was verified or the reasons why such verification was not sought because it was unnecessary); and 
   (c)    a full description of the article sold, hired, offered or exposed for sale or hire, lent or given to the customer.
2. The Licenceholder must ensure that any article listed in section 27A of the Civic Government (Scotland) Act 1982 or display of such articles is not visible from the street or any public entrance to the premises.
3. The Licenceholder must display a notice which must:
   (a) be displayed at all times at the point of entry to the premises, the point of sale or counter and in a position
         which is readily visible to customers
   (b) be at least A4 size and on which the lettering must be legible and no smaller than 5mm in height; and
   (c)  contain the following wording:
   • it is an offence to sell to a person under the age of 18 any knife or knife blade (except if the person is aged 16 or over and the knife or blade is designed for domestic use)
   • it is also an offence to sell to a person under the age of 18 any razor blade, axe, sword or other article which has a blade or which is sharply pointed and which is made or adapted for use for causing injury; and
   • a customer may be asked to provide details of his/her age and identity (which may be recorded or copied and kept for inspection for up to 3 years).
4. The Licenceholder must take all reasonable steps to establish from the customer and confirm the intended use of any sword.
5. The Licenceholder must make detailed written records on the day of the transaction with a customer and retain such records for a period of 3 years from that date stating the enquiries made of the customer or other persons or
6. The holder of a Knife Dealer's Licence shall not be less than 25 years of age.
7. All records maintained by the Licenceholder shall be kept for a period of 3 years.
8. The Licenceholder shall make all records available at any time for inspection by an authorised officer of the Licensing Authority or a constable.
9. The Licenceholder shall maintain a record of all refused transactions detailing the following information:
   (i)   The date of refusal 
   (ii)   Details of the transaction, including a description of the article not sold. 
   (iii)  The name and age of the customer (if known)
   (iv)  The reason for refusal
10. The Licenceholder shall ensure that all articles for sale are within lockfast cabinets or display units within the premises and shall ensure that all stock is stored in a lockfast store within an area of the premises inaccessible to the public.
11. The Licenceholder shall install and maintain adequate security measures in the premises.
12. The Licenceholder shall not engage the services of a person under the age of 18 to sell, hire, offer or expose for hire or sale, lend or give any licensed article to a customer.
13. The Licenceholder shall not without the prior written consent of the Licensing Authority offer for sale or hire any article other than those specified by the Licenceholder in his form of application for the Licence.
14. Where the Licenceholder changes his address, he shall within 14 days thereafter give notice thereof to the Licensing Authority and shall provide the Licence to the Legal Manager (Licensing) of the City of Glasgow Council who shall endorse thereon the particulars of such a change of address.
15. If during the currency of the Licence the Licenceholder is convicted of any offence, he shall within 28 days provide full details thereof to the Licensing Authority.
16. If during the currency of the Licence the Licenceholder ceases to trade, he shall within 3 months notify the Licensing Authority and surrender the Licence.
