Non-Material Variations
Non-material variations are permitted under Section 64 of the Town and Country Planning (Scotland) Act 1997, which makes provision for the variation of planning permission once it has been granted, provided the changes are not material.
If the improvements you propose do not significantly alter the development proposal that was initially granted at planning, you may be able to apply for a "Non-Material Variation" instead of an amended planning application. Hence, a Non-Material Variation application only relates to granted planning applications and is not applicable to other types of applications such as:
The following criteria will be applied when assessing the Non-Material Variation request:
- The proposed change must comply with development plan policy.
- The change does not require neighbour notification.
- The change does not require any additional planning conditions.
- The change does not affect any part of a development that has been specifically referred to in objections.
